Supreme Court Rejects Utah Highway Cross Case; Lower Court Ruled Crosses Violate Constitution

The Christian Post website reports today (November 1, 2011) that the U.S. Supreme Court has refused to hear an appeal of a case in which a Utah court ruled that roadside memorial crosses -- erected in honor of fallen highway troopers -- violate the U.S. Constitution.

The 12-foot-high white crosses in question -- which were paid for by the private Utah Highway Patrol Association -- were purported to be an endorsement of Christianity by the state.

American Atheists, Inc. had sued the association and claimed that the placement of the religious symbols on public grounds was unconstitutional and violated the First Amendment.

The Tenth Circuit Court of Appeals ruled in favor of the atheists, because the cross was the "preeminent symbol of Christianity."
