Cal. Can't Force Baking Lesbian Wedding Cake; Judge: 1st Amend. Protects Baker's Rel. Beliefs

In a decision being celebrated as a victory for religious freedom advocates, a California judge ruled yesterday that a Christian baker -- who faced losing her business because she refuses to bake cakes for same-sex weddings -- cannot be compelled by the state to do so, the Christian Post website reports today (February 6, 2018).


Cathy Miller, a Christian baker who owns Tastries Bakery in Bakersfield, California, was facing discrimination charges filed by the state after she refused to make a wedding cake for lesbians Eileen and Mireya Rodriguez-Del Rio last August, citing her religious beliefs.


"My conscience doesn't allow me to participate in certain activities that are contrary to my biblical beliefs," Miller said at the time.


In rejecting the state's petition against Miller, Superior Court Judge David Lampe said his opinion that her decision to refuse to bake cakes for same-sex weddings is protected by the First Amendment.
